The firebrand political activist was deported last month for his role in the contraversial swearing in of Nasa leader Raila Odinga.
The Immigration Department has asked Miguna to regularise his Kenyan citizenship before he can officially be allowed back in the country.
According to a press statement Director of Immigration Services Joseph Munywoki, Miguna lost his Kenyan status when he acquired the Canadian one in 1998, at a time when Kenya did not allow dual citizenship.
Munywoki said they had sent the application forms to JKIA, where Miguna is still being held since his arrival on Monday afternoon, for him to regularise his citizenship status.

Miguna Miguna has however maintained that he is Kenyan by birth and therefore his citizenship cannot be revoked. He reportedly ripped apart application forms from the Immigration department which were meant to regularise his Kenyan citizenship.

On Monday, Miguna Miguna fought off efforts by immigration officials together with security personnel to force him on a flight to Dubai as an undocumented person, which delayed the Emirates Flight EK 722 for hours.
