Attorney General, Professor Githu Muigai, has filed an appeal against the Friday court ruling, which gave its nod in allowance of the gay and lesbian rights’ group to register as an NGO.

Githu Muigai has maintained that he is only following the law as the proposed NGO for the gays and lesbians has a composite name that includes words which are legally unacceptable.

The High Court of Kenya, in a ground-breaking decision by judges Isaac Lenaola, Mumbi Ngugi and George Odunga, on April 24, 2015, ruled that members of lesbian, gay, bisexual, and transgender (LGBT) rights group could formally register their organization.

The ruling came about following a petition filed by the National Gay and Lesbian Human Rights Commission (NGLHRC), which sought to be allowed to register under the Non-Governmental Organizations Coordination Board Act.

In March 2013 the Non-Governmental Organizations Coordination Board, rejected the group’s request on grounds that the name of the organization was “unacceptable,” and that it could not register it because Kenya’s penal code “criminalizes gay and lesbian liaisons.”

CHURCH CONDEMNS RULING ON REGISTRATION OF LOBBY FOR GAYS AND LESBIANS

The church has vehemently condemned the high court ruling arguing that it doesn’t take into consideration the rich African and Christian tradition that has formed and still continues to form. Church leaders have also blamed the decision on president Obama’s anticipated visit to Kenya in July.

“The coming in July of Obama has a suspect relationship with the ruling because wherever he has visited in Africa those countries adopted lesbianism as a pre condition to aid,” said Bishop Mark Kariuki, Presiding Bishop and General Overseer of Deliverance Churches Kenya.

Archbishop Eliud Wabukala of the Anglican Church urged the Registrar of Societies not to honour the court order.

MPS CALL FOR APPEAL

Earlier in the week four MPs had petitioned Attorney General Githu Muigai and the Non Governmental Organization co-ordination board, to appeal the High Court ruling.

The MPs led by leader of minority Francis Nyenze (Kitui West), minority whip Thomas Mwadeghu (Wundanyi), Abdulswamad Nassir (Mvita) and Irungu Kangata (Kiharu) faulted the court’s ruling and rallied Christians, Muslims and the Hindus to condemn the move.
