The supreme court has upheld the election of Machakos governor Alfred Mutua, overturning the Court of Appeal ruling that had in June nullified his election.

The court also asked Wavinya Ndeti, who had filed the petition, to pay all the litigation costs.

The High Court had in February dismissed Wavinya Ndeti’s petition on grounds that it lacked merit and went ahead to slap the former Kathiani MP with SH 10M fine in legal fees.

She moved to the court of appeal, where the court ruled in her favour and nullified Mutua’s election.

Alfred Mutua moved to the supreme court to appeal the decision saying the appellate court misunderstood the case.

IEBC declared Mutua winner in the 2017 Machakos gubernatorial race after he garnered 238,405 votes against Wavinya’s 199,257.

The supreme court also upheld the election of Kwale governor Salim Mvurya.

Kirinyaga governor Anne Wiguru also had her election upheld by the Court of Appeal on Thursday, after the petition lodged by Narc’s Martha Karua was thrown out.

Nandi Hills MP Alfred Keter’s election has also been upheld.
