A high court judge has blocked Nkaissery’s attempted arrest of Joho. The Mombasa governor is said to own illegal guns.
The high court has barred the CS for Interior Joseph Nkaissery from arresting Mombasa governor Hassan Joho for failure to surrender his firearms as he had been mandated to.
Justice George Odunga suspended Interior CS Joseph Nkaissery’s decision to revoke Joho’s firearm license and confiscate his guns pending the determination of his application.
He further directed the respondents in the case to file their responses and appear before him on Friday.
“I hereby grant the applicant the orders sought pending hearing of the case. The respondents are restrained from taking any action against him,” he ruled.
A guns blazing Nkaissery had yesterday said that Joho would be in jail by 2pm if he failed to comply with an order to give up his firearms and told a Senate Committee that the governor could only appeal the decision upon surrendering the weapons.
“By 2pm I will have arrested the Governor and he will be in jail. The law is very clear on the mandate I was given”, Nkaissery said.
Joho was accompanied at the Milimani law courts by Siaya Senator and lawyer James Orengo, Opposition leader Raila Odinga, Senator Moses Wetangula and other leaders from coast.
The firearms issue surrounding Joho has been the recent spat between the government and the opposition with the later accusing the former of intimidation.
