Embakasi East MP Babu Owino has become the latest legislator to lose his seat after a high court nullified his election on grounds of irregularities.
High court Judge Joseph Sergon said there were errors and irregularities during the election process. He also slapped Babu Owino with a Sh 5 million fine in legal costs.
Babu Owino has accused President Uhuru Kenyatta and his deputy William Ruto of using the judiciary to settle scores, saying the two had a hand in the nullification of his election.
“The whole nation knows that this is a war between the president and the deputy president versus Babu. It is sad that the government is controlling the Judiciary,” he said.
“No one can destroy me. If either Uhuru or Ruto decides to vie against me in Embakasi East I will beat them seriously.”

The verdict comes just days after judge Joseph Sergon ordered a recount of the votes cast during the August elections, which confirmed that Babu Owino won the Embakasi East parliamentary race with 46,817 votes against the 42,501 his closest competitor Francis Mureithi garnered.
After the August 8, 2017 general election, Owino was declared winner with 46,587 votes against Mureithi’s 42,253.
Mureithi moved to court to challenge Babu’s owino election arguing that the election was not fair.
Babu owino has said that he will move to the court of appeal to challenge Sergon’s ruling.
“The judge ordered a scrutiny but we will appeal the decision. Any weapon set against me shall not prosper,” Babu said.
Babu Owino, who until his election as Embakasi East MP was the president of the Students Organisation of Nairobi University (Sonu), has been vocal about calling out president Uhuru’s re-election as illegitimate.
