The High Court has quashed a two-year jail term slapped on ex-Senator Joy Gwendo who was last month arrested and charged over an alleged Sh 2M fraud.
The High Court has quashed a two-year jail term slapped on ex-Senator Joy Gwendo for fraud saying the trial verdict was improper.
According to Justice John Onyiego, the Magistrate court erred in sentencing Gwendo to jail without the option of fine.
Gwendo was last month arrested and charged over an alleged Sh 2M fraud.
She was charged with five counts; stealing Sh2.2 million belonging to the Kisumu East Cotton Growers Co-operative Society, abuse of office, and fraud by forging a KCB’s banker’s cheque of Sh200, 000 in addition to issuing bouncing cheques. The offences were allegedly committed in October and December 2016.
Chief Magistrate Douglas Ogoti had sentenced the former nominated Senator to two years in prison.
Justice Onyiego instead said the high court will sentence Gwendo afresh on the 4th of March.
