Former Msongari student sues school over car crash. The former student is looking for Kshs 28 million in compensation for her injuries.
A 19-year-old former student of Loreto Convent Msongari Girls Primary School has sued the institution for Sh28 million compensation for a car accident that affected her and her classmates in 2011.
Madikizela Otieno, currently a law student at Nottingham University in the United Kingdom, wants the school compelled to pay the amount as compensation for the pain she underwent, her injuries and for offsetting future medical expenses.
She told the Court the accident cost her parents Sh14 million in local hospitals, Sh2.1 million in a UK hospital, and that she was yet to recover fully.
“I was admitted at Nairobi hospital for 42 days and was later referred to Bupa Cromwell Hospital in London. I suffered serious multiple injuries and incurred heavy expenses for which I seek compensation,” she said in a sworn statement.
Ms Otieno blamed the school for the accident saying the bus was overloaded on that fateful day that pupils were ordered to sit on each other’s laps, adding that it also had faulty brakes and that the driver was reckless.
“I remember hearing screeches as the driver tried to apply brakes,” said Ms Otieno, adding that the bus rolled several times.
Three pupils were killed while 69 others and seven teachers were injured in the accident along the Meru-Nanyuki Highway on July 27, 2011.
The case will be heard on October 30, 2017.
