Waiguru implicates Duale in NYS scandal, Duale refutes

Majority leader, Aden Duale (pictured), has denied the allegations made by former CS for devolution Anne Waiguru, that he was involved in the Sh791 M National Youth Service scandal (NYS) scandal.

Duale, who solely addressed a press conference yesterday, accused Waiguru of having a psychiatric condition saying that she stole the NYS millions and was now looking for people to blame.

“Waiguru should provide any iota of evidence to investigative authorities and I will respond.” The National Assembly Majority leader said.

“Your place is in Kamiti prison, you have touched a live wire and now I will go for Anne Waiguru starting today,” he added.

In an affidavit filed in court on Tuesday, Anne Waiguru linked senior Jubilee politicians including Duale, Elgeyo Marakwet Senator Kipchumba Murkomen, DP William Ruto’s younger brother Luke Samoei and Personal Assistant to the DP Farouk Kibet of having played roles in influencing the fraudulent payments at the center of the scandal.

According to Waiguru, then acting Senior Deputy Director General of NYS, Adan Harakhe informed her through a memo that he was being intimidated by Murkomen and Duale.

Duale also allegedly warned Harakhe of dire consequences should he fail to instruct the DCI to stop the investigations.

“Mr Harakhe was texted and called by Mr Aden Duale who advised him that he required political support and that leaders from his region came from URP. Mr Duale warned that he needed to be careful lest he is used and dumped by the other side of the coalition,” says Waiguru.  “The alleged memo dated June 8, 2015 states.

STOP DCI INVESTIGATIONS

Waiguru also claimed that Murkomen visited her office in the company of Samoei to allegedly solicit for a contract for Samoei’s company.

“At noon, Murkomen visited my office in the company of a person he introduced as Luke Kimutai Samoei, the younger brother of his Excellency DP Ruto,” she said in the affidavit.

She also accuses the senator of pushing for the illegal payments for companies associated to suspects’ Ben Gethi and Kabura.

According to Waiguru, Murkomen stated that he represented his clients who were the merchants whose funds had been stopped at the IFMIS and whose bank accounts were frozen by the DCI. Waiguru says the accounts frozen were those associated with Josephine Kabura and Ben Gethi.

“Around the same month of July, Senator Murkomen visited my office and informed me that he represents his clients who were merchants whose funds had been stopped at IFMIS. Murkomen passed the message from his clients stating that I tell DCI to drop the investigations and said I could face unspecified consequences if I did not adhere to these demands,” she said. Waiguru said she refused to yield and pushed the DCI to conclude the investigations.

MURKOMEN TELLS OFF WAIGURU

Kipchumba Murkomen has denied being party to the National Youth Service (NYS) scam following an affidavit by former Devolution Cabinet Secretary Anne Waiguru linking him to the 791 million shillings loss at the service and maintained that he only admitted that he offered legal services to businessman Ben Gethi.

He accused Waiguru of trying to create a conflict in the Jubilee coalition and told her to focus on claims made by Kabura and stop the sideshows of dragging him into the NYS saga.

“My personal advice to the CS is to stick to the questions raised by and account for her tenure without resorting to diversionary tactics and pitting the coalition partners against each other. That will not work as we are above that.”

Waiguru made the allegations on Tuesday, a day after she was grilled for the second time in three months by anti-graft detectives over the Sh791 million NYS scam following the damning accusations by business woman, Ms Josephine Kabura Irungu, who in a sworn affidavit deposited in court said that the CS planned, facilitated and protected the people involved in the NYS scandal.
